LIPHA Privacy Policy

This Privacy Policy governs your use of the Learning Inter-professionally Healthcare Accelerator (“LIPHA”). Baycrest Centre for Geriatric Care (“Baycrest”, “we” or “us”) respects the privacy of users of LIPHA (“you”, “your” or “User” throughout), and is committed to the confidentiality and security of the personal information we hold. Personal information is information about an identifiable individual, either alone or when combined with other information.

Baycrest operates the mobile application, LIPHA, using software licensed by Launch57 Inc. (“Launch 57”). Please read this Privacy Policy carefully as this describes how we collect, use, disclose and safeguard User-related information (including personal, de-identified and aggregate information) in connection with LIPHA. By accessing our App, you understand and agree to the collection, use and disclosure of your personal information by us, each and every time, in the manner described in this Privacy Policy. In addition to this Privacy Policy, Users should consult the Terms of Use for LIPHA and other notices posted within LIPHA, which are incorporated as part of the Terms of Use. Any terms not otherwise defined in this Privacy Policy have the same meaning as in our Terms of Use. This Privacy Policy does not apply to business contact information provided to us (except where required by law), to certain publicly available information, nor to the collection, use or disclosure of information relating to corporate or commercial entities.

 

Acceptance of Privacy Policy

Use of LIPHA is offered to you by Baycrest only if you accept this Privacy Policy.

LIPHA is only available for use by those who may lawfully enter into contracts with us under our laws.

Baycrest reserves the right, in its sole discretion, to modify, alter or otherwise update this Privacy Policy at any time without prior notice or liability to you. Any subsequent use by you of LIPHA following changes to this Privacy Policy signals your acceptance of these changes.

Collection of Personal Information

Baycrest may collect the following personal information through LIPHA:

  • First name, last name
  • Email address
  • Postal code
  • If applicable, student status, year of study, program of study and school.
  • If not a student, then role (e.g., nurse, personal support worker, physician, educator, family member, caregiver, volunteer) and organization/place of work.
  • You may also choose to sign up for email, SMS and/or phone alerts under your profile.
  • We also collect your ‘display name’, which is the gaming handle/nickname you have chosen. We do not collect any cookies or any technical information from you.

 

Cookies

Cookies are files with a small amount of data that are commonly used as anonymous unique identifiers. These are sent to your browser from the websites that you visit and are stored on your device’s internal memory.

This Service does not use these “cookies” explicitly. However, the app may use third party code and libraries that use “cookies” to collect information and improve their services. You have the option to either accept or refuse these cookies and know when a cookie is being sent to your device. If you choose to refuse our cookies, you may not be able to use some portions of this Service.

 

Links to Other Sites

This Service may contain links to other sites. If you click on a third-party link, you will be directed to that site. Note that these external sites are not operated by us. Therefore, we strongly advise you to review the Privacy Policy of these websites. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services.

 

Use of Personal Information

LIPHA Personal Information: We collect your personal information, as listed above, to deliver educational content, administer your account, to respond to inquiries you send to us and to send you administrative communications about LIPHA. Administrative communications may include information related to the availability of new LIPHA version updates or password change requests (app and desktop versions of LIPHA). If you are using the desktop version of LIPHA, you might receive app-related notifications (e.g., to notify you that a new badge has been earned, a new case has been unlocked).

When you register for the app version of LIPHA, we ask you if you wish to receive notifications. If you allow notifications, we may send you

invitations to programs and events; and

optional further educational, program evaluation or research opportunities. You may choose not to participate in these opportunities. The choice is entirely yours and this will not impact your ability to continue to use LIPHA.

You can choose not to subscribe to these, or unsubscribe from such notifications at any time by disabling the notification feature in LIPHA under “System Settings”.

For the desktop version of LIPHA, we may occasionally send you information about optional evaluation or research activities at Baycrest (such as links to surveys, invitations to interviews and focus groups). Although these links will automatically appear in the desktop version of LIPHA (such as in your news feed), you may choose not to participate. The choice is entirely yours, and this will not impact your ability to continue to use LIPHA.

Helpdesk Ticket Data: LIPHA uses a third-party helpdesk ticketing service called Spiceworks. In the event that you submit a technical support inquiry or ticket through Spiceworks, your first name, last name, email address, and any content reported in the ticketing system may be stored in the United States. Your helpdesk tickets will only be accessed by an authorized Baycrest or Launch57 staff member for the purposes of providing technical support. Use and Disclosure of De-identified or Aggregate Data

We may use and disclose de-identified and/or aggregate data generated from our Users for the purposes of Ministry of Long-Term Care project reporting and for research, evaluation and analytical purposes and/or for quality improvement purposes, including improvement of our educational services. This data will not identify you.

We may also disclose de-identified and/or aggregate information collected through LIPHA with our research partners and other organizations to measure and quantify the effectiveness of LIPHA for learning and for care and organizational outcomes. De-identified and/or aggregate information collected through LIPHA may be included in academic publications, conference posters/presentations, websites, marketing materials, and social media about LIPHA. If you choose to provide a quote when you provide your feedback, your name will be removed from the quote before any public dissemination.

Aggregated data may be derived from your personal information but is not considered personal information in law as this data does not directly or indirectly reveal your identity. However, if we combine or connect aggregated data with your personal data such that it can directly or indirectly identify you, we treat the combined data as personal information which will be used in accordance with this Policy.

 

Disclosure of Personal Information

To encourage a community of learning, LIPHA has a public “player leaderboard” which lists the ‘display names’ of players with the current highest scores. Some versions of LIPHA also include discussion forums which also list the display name. If you choose a username or display name that includes personal information about yourself (such as your first and/or last name), this information will be identifiable to others.

LIPHA Personal Gameplay Data: If your employer, school or Baycrest assigned you this account as part of their ‘enterprise’ license, your individual-level, identifiable data (e.g., name, email address, app performance metrics, quiz or activity grades, number and type of badges earned, number and type of LIPHA levels completed) may be shared with your organization for educational and training purposes. Please consult with your organization to learn more about how they intend to use your LIPHA data. We will retain anonymized copies of all gameplay data submitted.

We do not sell, rent, distribute or otherwise disclose your personal information collected through LIPHA to any third parties except in the ways specified below.

We may disclose your personal information to our service providers (including Launch57 and their subcontractors) so they can provide their services to us. In each case, we will ensure that these third parties have agreed not to use or disclose your personal information except to provide us such services in connection with LIPHA.

Baycrest may be required to disclose personal information by law, such as in response to a subpoena, court order or other legal authority.

 

International Transfers

Baycrest is located in Ontario, Canada. We will collect, store, and process your information that we obtain from the use of LIPHA and these activities shall be governed by applicable Ontario and Canadian laws and regulations and this Privacy Policy. In addition, we may transfer your information outside Canada to third party service providers with operations in other countries. By using LIPHA, you consent to such collection, storage and processing in Canada and elsewhere, although other jurisdictions may not afford the same level of data protection as considered adequate in your own country. We will take reasonable steps to protect your information.

 

Security Measures and Transmissions over the Internet

We use commercially reasonable security measures to safeguard the security of LIPHA in order to prevent access, loss, interception or alteration by unauthorized parties. Such security measures include physical security measures, organizational controls on access to information, and electronic safeguards such as passwords, firewalls and SSL level encryption, where and as appropriate. We also require our partners, suppliers and agents to implement reasonable security measures to safeguard the security of LIPHA.

While we use commercially reasonable security measures to safeguard the security of LIPHA, the transmission of data over the Internet or other publicly accessible networks is inherently insecure, and is subject to possible unauthorized access, loss, interception or alteration while in transit. Accordingly, neither Baycrest nor Launch57 assume any liability for any damage you may experience or costs you may incur as a result of any transmissions over the Internet or other publicly accessible networks, and in no event will the information you provide to us result in any liability to you on our part in the event that such information is inadvertently released by us or accessed by third parties without our consent. Notwithstanding the foregoing, to the extent that you are able to access the information of third parties through LIPHA, we do not grant you any right or license to use such information.

Retention of Information

We will retain your personal information for as long as your LIPHA account is active or as needed to provide you with use of LIPHA, or to comply with our legal obligations, resolve disputes, and enforce our agreements.

Correcting or Access Your Personal Information

We rely on you to ensure that the personal information you enter into the App is as accurate, complete and up-to-date as necessary for the purposes for which it is intended to be used. You may review and update your personal information in the App.

You have a right to access your personal information held by us. You also have a right to know if your personal information has been shared with any third parties. To access personal information about yourself held by Baycrest, please contact us at privacy@baycrest.org. Baycrest reserves the right to charge a reasonable fee for copying the requested information. Unless required by law, we may reject requests that are unreasonably repetitive, require disproportionate technical effort, risk the privacy of others, or for other legal reasons as the case may be.

 

Withdrawing Consent

If you wish to withdraw your consent for the collection, use or disclosure of your personal information, please contact our Privacy Officer at the address below. Withdrawals of consent apply on a go-forward basis. Please note that your withdrawal of consent may prevent us from offering you continued use of LIPHA, in whole or in part.

Your withdrawal of consent is not retroactive since we may already have used your personal information for the purposes described in this Privacy Policy (for example, see “Use of De-Identified and Aggregate Data” above). As noted, we will retain and use your personal information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements.

 

Children’s Data

LIPHA is designed and intended for use by adults (18 years and older) and is not intended for nor designed to be used by children under the age of 18. We do not collect personal information from any person we know to be under the age of 18. If you think a child may have accessed the App or provided us with personal information, you may request the deletion of any information provided to and retained by us by writing to us at privacy@baycrest.org.

 

Changes to Our Privacy Policy

We may update this Privacy Policy from time to time will post updates on this page, and on the date posted, they are in effect. Please visit our page to stay up to date on the current version.
